1. Definitions

In these Terms of Service, the following definitions apply:

• "Service" — The GymCraft Coach platform, including the website, web application, APIs, and all related services operated by GymCraft Inc.
• "User" — Any individual or entity that creates an account and uses the Service.
• "Coach" — A User who subscribes to the Service to manage clients, create training programs, and deliver coaching services.
• "Client" — An individual who receives coaching services through a Coach using the Service.
• "Subscription" — A recurring payment plan that grants access to premium features of the Service.
• "Content" — Any data, text, images, videos, training programs, workouts, or other materials created, uploaded, or stored using the Service.
• "GymCraft" — GymCraft Inc., the company that owns and operates the Service.

2. Our Services

2.1 Service Description

GymCraft Coach is a professional coaching platform that enables fitness coaches and personal trainers to:

• Create and manage training programs and workouts
• Manage client relationships and progress
• Deliver personalized training plans to clients
• Track client progress and analytics
• Communicate with clients through the platform
• Manage teams and collaborate with other coaches (Max subscription)

2.2 Service Availability

We strive to maintain 99.9% uptime for our Service. However, we do not guarantee uninterrupted access and may perform maintenance that temporarily affects availability. We will provide reasonable notice for scheduled maintenance when possible.

2.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of significant changes that affect your use of the Service.

3. User Accounts

3.1 Account Registration

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Fail to pay subscription fees when due
• Provide false or misleading information
• Pose a security risk to the Service or other users

4. Subscription & Billing

4.1 Subscription Plans

GymCraft Coach offers the following subscription tiers:

• Free: Basic features with limited capacity
• Pro: Professional features for growing coaches
• Ultra: Advanced features for established coaching businesses
• Max: Full platform access including team management

Feature limits and pricing are displayed on our pricing page and may be updated from time to time.

4.2 Payment Processing

All payments are processed through our payment provider, Paddle. By subscribing, you agree to Paddle's terms of service. We accept major credit cards and other payment methods as displayed during checkout.

4.3 Billing Cycle

Subscriptions are billed either monthly or annually, depending on your selection. Your subscription will automatically renew at the end of each billing period unless cancelled.

4.4 Price Changes

We may change subscription prices at any time. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers. Your subscription will automatically renew at the new price unless you cancel.

4.5 Refund Policy

All sales are final. Due to the immediate access to digital services, purchases are non-refundable. If you cancel your subscription, you will retain access until the end of your current billing period, but no refund will be issued for the remaining time.

4.6 Failed Payments

If a payment fails, we will attempt to process the payment again. If payment continues to fail, your subscription may be suspended or terminated. You are responsible for ensuring your payment information is current and accurate.

5. License Agreement

5.1 License Grant

Subject to your compliance with these Terms, GymCraft grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business coaching activities.

5.2 License Restrictions

You may not:

• Sublicense, sell, or transfer your access to the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to develop a competing product or service
• Copy or reproduce any part of the Service without permission
• Use automated systems to access the Service (bots, scrapers, etc.)
• Share account credentials with unauthorized users
• Circumvent any security measures or access restrictions

5.3 Intellectual Property

The Service, including all software, design, text, graphics, and other content, is owned by GymCraft and protected by copyright, trademark, and other intellectual property laws. You retain ownership of the Content you create using the Service.

6. Acceptable Use

6.1 Prohibited Activities

When using the Service, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Upload malicious code or content
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with the proper operation of the Service
• Attempt to gain unauthorized access to the Service or other accounts
• Use the Service for any illegal purpose

6.2 Content Standards

All Content you create or upload must not:

• Be defamatory, obscene, or offensive
• Promote illegal activities
• Infringe on intellectual property rights
• Contain personal information of others without consent
• Contain malware, viruses, or harmful code

7. Data & Content

7.1 Your Content

You retain ownership of all Content you create using the Service. By using the Service, you grant GymCraft a limited license to host, store, and display your Content as necessary to provide the Service.

7.2 Data Security

We implement industry-standard security measures to protect your data. However, no method of transmission or storage is 100% secure. You acknowledge and accept the inherent risks of transmitting data over the internet.

7.3 Data Export

You may export your Content at any time through the Service's export features. Upon account termination, you will have a limited period to export your data before it is deleted.

7.4 Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMCRAFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION.

8.3 Maximum Liability

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

8.4 Professional Advice

The Service is a tool for fitness coaches and does not constitute medical, health, or fitness advice. Coaches are responsible for ensuring their programs are appropriate for their clients. GymCraft is not responsible for any injuries or health issues that may result from training programs created or delivered through the Service.

9. Termination

9.1 Termination by You

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to the Service until that time.

9.2 Termination by Us

We may terminate or suspend your account immediately if you violate these Terms. We may also terminate inactive accounts or accounts without paid subscriptions after a period of inactivity.

9.3 Effect of Termination

Upon termination:

• Your license to use the Service immediately ends
• You must cease all use of the Service
• You will have a limited period to export your Content
• After the export period, your Content may be deleted
• Provisions that should survive termination will remain in effect

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 15 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of San Francisco County, California.
